These Terms of Service ("Terms") are a legal agreement between you and Bamboo Labs LLC ("Bamboo Labs," "we," "us," or "our"). They govern your access to and use of our website at bamboolabsllc.com, our software products and services, our hardware, and the MadeBearyWell store (together, the "Services"). By creating an account, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Individual products may have their own additional terms or guidelines. Where a product's terms conflict with these Terms, the product-specific terms control for that product.
You must be at least 13 years old to use the Services, and old enough to form a binding contract in your jurisdiction. Some products require you to be 18 or older; those requirements are stated in the product. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
Some Services require an account. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.
You keep ownership of the content you create, upload, or submit through the Services ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content only as needed to operate and provide the Services to you. You are responsible for Your Content and for having the rights necessary to share it. You must not post content that is unlawful, infringing, harmful, or that violates the rights of others.

When you buy hardware or merchandise from the MadeBearyWell store, you agree to pay the listed price plus any shipping and taxes. Title and risk of loss pass to you when the carrier delivers the item. We try to describe products accurately, but colors, specifications, and availability may vary. Returns and warranty details are covered in our Refund and Return Policy.
Payments are processed by third-party providers such as Stripe and the app stores. By making a purchase, you authorize us and our payment providers to charge your selected payment method. We do not store full card numbers.
The Services, including their software, design, text, graphics, and logos (but not Your Content), are owned by Bamboo Labs or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. All rights not expressly granted are reserved.
The Services may link to or rely on third-party services and websites. We are not responsible for third-party content or practices, and your use of them is governed by their own terms.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
To the maximum extent permitted by law, Bamboo Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars.
You agree to indemnify and hold harmless Bamboo Labs from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your infringement of the rights of others.
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue a Service. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.
These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Duval County, Florida, and you consent to their jurisdiction, except where the law gives you the right to bring a claim elsewhere.
We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.
